Adequate instruction was not provided to workers concerning the designation of hopper style rail cars as permit required confined spaces, and the hazards associated with working over and/or near the opening.

29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces and did not comply with paragraphs (c)(1), (c)(2), (c)(6), and (c)(8) of this section: Employees were exposed to engulfment/asphyxiation hazards when vacuuming/removing grain product from hopper style rail cars while straddling, or standing adjacent to the open rail car hatch(s). An effective procedure had not been developed or implemented to ensure workers did not enter the open hatches of the hopper style rail cars when working over and/or near the opening.
