29 CFR 1910.1048(d)(2): Employees who may have been exposed at or above the action level or STEL were not identified, and the exposure was not accurately determined for each identified employee:   (a) Facility wide - The employer did not perform an initial monitoring of those employees exposed or potentially exposed to formaldehyde while using Inova Professional Pure Keratin. Laboratory analysis yielded a concentration of 2.2% formaldehyde for this hair treatment. The condition was noted on or about July 22, 2014.   The Zoog Hair Salon Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1048(d)(2), which was contained in OSHA inspection number 316219997, citation number  1, item number 1 and was affirmed as a final order on 04/15/2013, with respect to a workplace located at 28 West 39th St. New York, NY 10018.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1048(m)(5): The employer did not develop, implement, and maintain at the workplace, a written hazard communication program for formaldehyde exposures in the workplace:    (a) Facility wide -  Employees applying the Inova Professional Pure Keratin treatment are exposed to formaldehyde. The employer did not develop a written hazard communication program. Laboratory analysis yielded a concentration of 2.2% formaldehyde for this hair treatment. The condition was noted on or about July 22, 2014. 29 CFR 1910.1048(n)(1): The employer did not ensure that all employees who were assigned to workplaces where there was exposure to formaldehyde participated in a training program:   (a) Facility wide -  Employees applying the Inova Professional Pure Keratin treatment are exposed to formaldehyde. The employer did not train the employees on the hazards associated to the chemical they are exposed to. Laboratory analysis yielded a concentration of 2.2% formaldehyde for this hair treatment. The condition was noted on or about July 22, 2014.
