29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite, Park Place Development, Cranberry Township, PA: On or about 07/22/14 an employee engaged in residential construction activities was not protected from falling by the use of guardrail systems, safety nets, or personal fall arrest systems. The fall hazard to the employee was approximately 36 feet to the ground.

29 CFR 1926.503(c)(3): Retraining was not conducted when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. (a) Jobsite, Park Place Development, Cranberry Township, PA: On or about 07/22/14 retraining was not conducted on fall protection systems or equipment when inadequacies in an affected employee's knowledge and use indicated the employee had not retained the requisite understanding and skill. An employee was exposed to a fall hazard of approximately 36 feet indicating the employee failed to retain the knowledge and skill to prevent falls.
