29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.    a. At the south/west side of the worksite where employees were working from a tubular frame scaffold, the scaffold was not designed by a qualified person, thereby exposing employees to fall hazards.    b. At the south/east side of the worksite where employees were working from a tubular frame scaffold, the scaffold was not designed by a qualified person, thereby exposing employees to fall hazards.

This provision does not preclude the use of common support members, such as "T" sections, to support abutting planks, or hook on platforms designed to rest on common supports.    a. At the south/east side of the building where employees were working from a scaffold, the abutted ends were laid across non-structural 2 inch by 4 inch lumber wedged across the scaffold frames, thereby exposing employees to a fall hazard.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.    a. At the worksite where employees erected and dismantled scaffolds, there was no competent person qualified to supervise and direct the erection or dismantling of scaffolds. The employees who conducted this work were not trained due to there being no competent person, thereby exposing employees to 16 to 35 foot fall hazards.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    a. On the south/east side of the building where employees were installing stone to the exterior of the building, guardrails were not installed along all open sides and ends of the platforms, thereby exposing employees to a 16 foot fall hazard.    b. On the south/west side of the building where an employee was removing plastic window coverings of the forth floor windows, guardrails were not installed along all open sides and ends of the platform, thereby exposing employees to a 35 foot fall hazard.

29 CFR 1926.452(c)(2): Frames and panels shall be braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally. The cross braces shall be of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections shall be secured.    a. On the south/east side of the building where scaffold frames were erected to support the scaffold between two roofs, the frame was not braced, thereby exposing employees to a 16 foot fall hazard.
