OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to the employee(s) in that the employee(s) were exposed to a crushing hazard:  On or about July 30, 2014, at the Anna P. Tooke Memorial Library site, the equipment operator of a Case 850 series crawler dozer was not wearing the seatbelt provided by the manufacturer while operating the dozer during site preparation.  Among other methods, one feasible and acceptable abatement method would be to ensure that the operator(s) of the dozer have read and understand the safety, operation and maintenance instructions in the manual prior to operation, and utilize the seat belt provided by the manufacturer, such as specified by the operator's manual.
