29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system:  (a) Jobsite, 465 Pittsburgh Road, Butler, PA:  On or about 07/31/14 two employees working in an aerial lift approximately 23 feet above the ground were not wearing a harness and lanyard tied off to the boom or basket.

29 CFR 1926.454(c)(3): The employer failed to retrain employees that showed indications through work performance of not retaining the requisite proficiency:  (a) Jobsite, 465 Pittsburgh Road, Butler, PA:  On or about 07/31/14 the employer failed to retrain employees on the proper use scaffolds when their work performance indicated they had not retained the requisite proficiency to work safely.  Employees were working on scaffolds and were not protected from fall hazards indicating the employees had not retained the skill and knowledge necessary to prevent exposure to falls.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    (a) Jobsite, 465 Pittsburgh Road, Butler, PA:  On or about 07/31/14 two employees working on a steep roof approximately 25 feet above the ground were not protected from falling by the use of guardrails, safety nets or personal fall arrest systems.

29 CFR 1926.503(c)(3): Retraining had not been conducted when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.   (a) Jobsite, 465 Pittsburgh Road, Butler, PA:  On or about 07/31/14 the employer had not retrained employees when inadequacies in the employees' knowledge or use of fall protection indicated the employees had not retained the understanding and skill to prevent falls.  Employees were working at heights up to 25 feet without fall protection systems in place indicating the employees failed to retain the skill necessary to protect themselves from fall hazards.
