29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:   (a) On or about July 31, 2014, and at times prior, We Recycle Cooperation, LLC., did not ensure that open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were guarded by standard railings on all open sides. The top level of the conveyor loft in the sorting shop, did not have a standard guardrail on its open side, exposing employees to fall hazards of up to 8 feet. 29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, that date of evaluation, and the identity of the person(s) performing the training or evaluation:   (a) On or about July 31, 2014, and at times prior, We Recycle Cooperation, LLC., did not ensure that each forklift operator was trained and evaluated as required by 29 CFR 1910.178 paragraph (l). Employees were exposed to struck-by hazards, in that the operators of a John Deere 313 skid loader, and a Nissan electric forklift, were not trained and evaluated as required by paragraph(l). 29 CFR 1910.157(e)(3): Portable fire extinguishers were not subjected to an annual maintenance check:  (a) On or about July 31, 2014, and at times prior, We Recycle Cooperation, LLC., did not ensure that portable fire extinguishers were subjected to an annual maintenance check. An Amerex dry-chem portable fire extinguisher was observed mounted on the north wall of the recycling shop, the annual maintenance tag on the fire extinguisher showed an expiration date of October 2013, exposing employees to fire hazards. Access to the main electrical panel in the recycling shop was blocked off by a forklift charger and other assorted items, preventing ready and safe operation of the panel and exposing employees to electrical hazards. 29 CFR 1910.1200(e)(1): 29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph:    (a) On or about July 31, 2014, and at times prior, We Recycle Cooperation, LLC., did not ensure that a written hazard communication program was developed, implemented, and maintained at the workplace. Employer uses chemical substances, such as motor oils, diesel fuel, and cleaning solutions as part of their operations. The lack of a written hazard communication program exposed employees to chemical hazards.
