29 CFR 1926.451(h)(4)(ii):  Toeboards securely fastened in place at the outermost edge of the platform had more than 1/4 inch (0.7 cm) clearance above the walking/working surface.   a) West side of Building E-2: The toeboard secured to the north end of the tubular welded frame mason's scaffold had an opening of approximately 1.5 inches between it and the edge of the working platform.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59:  a) Worksite: The employer could not produce a written Hazard Communication Program which covered employees working with hazards at the site such as; EIFS system containing;  Primus acrylic-modified adhesive and base coat; Portland cement; Dryvit reinforcing fabric; and a DPR finish coat.
