29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs, as necessary, to comply with this part. On August 10, 2014, employees were exposed to hazards while performing painting activities on a communication tower and the employer did not ensure safety and health programs that covered the hazards associated with communication towers were initiated and maintained. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge, which was 6 feet (1.8 m) or more above a lower level, was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer did not ensure that the employees utilized fall protection while ascending, descending, and moving around on the tower at the cited worksite, exposing them to a fall hazard greater than six feet. Abatement documentation is required for this item in accordance with the requirements of 20 CFR 1903.19(d).

On August 10, 2014, an employee was exposed to a 90 foot fall hazard while performing painting activities on a communication tower due to the use of a defective positioning device system. The employer did not ensure that the defective positioning device system was removed from service. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
