OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazards from hot work operations which were performed on tanks that contained flammable materials and were not made fire safe:      A.)  Metallico Inc. Goodman Services Inc Division - On or about 8/7/14, a Stihl Chop Saw which produces frictional heat and sparks was utilized to cut holes in crude oil tanks. The tanks were not cleaned of flammable materials and/or substances with absolute certainty that such materials were no longer present in the tanks before cutting on the tanks with the chop saw.  In addition, the tanks were not adequately ventilated, purged, and/or inerted before the chop saw was utilized to cut holes in the tank in order to prevent flammable vapors from creating an explosion hazard.  Potential sources of flammable vapors included but were not limited to, crude oil and/or crude oil sludge/residue.  One of the crude oil tanks exploded while an employee was utilizing the chop saw to cut holes in the side of the crude oil tank.      B.)  Metalico, Inc.  Goodman Services, Inc. Division - On or about 8/7/14, a Stihl Chop Saw which produces frictional heat and sparks was utilized to cut holes in crude oil tanks. Potential sources of flammable vapors included but were not limited to, crude oil and/or crude oil sludge/residue.  Employees had not received training on the hazards of performing hot work on tanks and containers which previously contained flammable materials.

29 CFR 1910.145(c)(1)(ii): All employees were not instructed that danger signs indicated immediate danger and that special precautions were necessary.      A.)  Metallico, Inc. Goodman Services Inc Division - On or about 8/7/14, the Stihl chop saw contained warning and danger labels.  Employees were not trained on the danger instructions/warnings on the Stihl chop saw labels.  The saw lablels spoke to fire and/or explosion hazards in flammable atmospheres.

A.)  Metalico Inc. Goodman Services, Inc. Division - On or bout 8/7/14, the company did not have OSHA 300 Summary Sheets for 2010.        B.)  Metalico Inc. Goodman Services, Inc. Division - On or about 8/7/14,The company also did not have the OSHA 300 log for 2010, 2011, 2012. or 2013.
