OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: (a) On or about August 12, 2014, and at times prior, the employer did not ensure the Cat TH63 rough terrain fork truck had the capacity ratings in a location that the operator could see them. 29 CFR 1926.405(g)(2)(iii): Flexible cords were not used in continuous lengths without splice or tap: (a) On or about August 12, 2014, and at times prior, employees were exposed to electrical and fire hazards from the electrical cord of the Target 19 inch, 208V, masonry saw that was spliced. The original black cord and was still connected to the temporary electrical panel and a tied with wire nuts to a blue cord that was connected to the saw. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws: (a) On or about August 12, 2014, employees were exposed to shock and other electrical hazards from the cord that connected the secondary construction trailer to the temporary electrical panel on the east side of the auditorium that was under construction because the cord insulation was not connected to the fitting thus placing strain directly on the live conductors. (b) On or about August 12, 2014, employees were exposed to shock and other electrical hazards from the extension cord that connected the mason's hammer drill to a generator, in that the cord insulation was pulled back from the plug placing strain directly on the live conductors. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
