29 CFR 1910.176(b): Storage of material created a hazard. The employer does not ensure that the storage of material did not create a hazard. This violation occurred on or about August 14, 2014 in the warehouse area where employees were exposed to a struck-by hazard when working near a storage rack which had a damaged support leg. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the storage of material does not create a hazard.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). The employer does not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely. This violation occurred on or about August 14, 2014, when an employee in the facility was required to operate a forklift without having been trained and evaluated. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely.
