OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of falling which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about August 14, 2014, on the east side of newly built metal building where an employee was exposed to an approximately 15 foot fall hazard. The employee was working from a platform being held aloft by a rough terrain forklift. The platform length exceeded the wheel base of the forklift greater than 10 inches measured across the load bearing tires on each side. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold more than 10 feet above a lower level are protected from falling to that lower level.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:(a)(LOCATION)(TYPES OF FORKLIFTS USED)(DESCRIPTION OF PLATFORM)(DESCRIBE HAZARD(S) WHERE NECESSARY) The employer does not secure platforms to the lifting carriage and/or forks. This violation was observed on or about August 14, 2014, on the east side of newly built metal building where an employee was exposed to an approximately 15 foot fall hazard while installing metal siding from a work platform without the platform being secured to the lifting carriage and/or forks. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each safety platform is secured to the lifting carriage and/or forks.
