29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports:   The employer does not ensure that each platform on all working levels of scaffolds are fully planked or decked between the front uprights and the guardrails.  This violation occurred on or about August 20, 2014, on the east side of the hotel where employees were exposed to a fall hazard when applying stucco to the exterior surface of a hotel from a scaffold that was not fully planked.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each platform on all working levels of the scaffold are fully planked or decked between the front uprights and the guardrails.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.   The employer does not ensure that scaffold platforms more than 2 feet above or below a point of access are not accessed by the cross braces.  This violation occurred on or about August 20, 2014, on the east side of the hotel where employees applying stucco to the exterior surface of the hotel were exposed to a fall hazard when using the cross braces of the scaffold to access the working platform.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffold platforms more than 2 feet above or below a point of access are not accessed by the cross braces.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees:    The employer does not ensure that makeshift devices are not used on scaffold platforms to increase the working level height of employees.  This violation occurred on or about August 20, 2014, on the east side of the hotel where an employee was exposed to a fall hazard when applying stucco to the exterior face of the hotel from a bucket on the second tier of the scaffold to gain additional height.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ensure that makeshift devices are not used on scaffold platforms to increase the working level height of employees.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   The employer does not ensure that each employee on a scaffold more than 10 feet above a lower level is protected from falling to the lower level.  This violation occurred on or about August 20, 2014, on the east side of the hotel where employees were exposed to a fall hazard greater than 10 feet when applying stucco to the exterior of the hotel without guardrails on the scaffold.      Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold more than 10 feet above a lower level is protected from falling to the lower level.

This violation occurred on or about August 20, 2014, on the east side of the hotel where employees were exposed to a fall hazard when applying stucco to the exterior of the hotel when the front edge of the platform was more than 18 inches from the face of the work.      Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the front edge of platforms is not more than 18 inches from the face of the work.

This violation occurred on or about August 20, 2014, on the east side of the hotel where employees were exposed to a fall hazard when applying stucco to the exterior surface of a hotel from a scaffold without cross bracing on the interior side of the scaffold.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that tubular welded frames are braced by cross, horizontal or diagonal braces.
