29 CFR 1910.5(a): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from being thrown from a compactor roller:  On or about August 22, 2014, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) and while operating a Caterpillar compactor roller, model number CB24.   Among other methods, several feasible and acceptable methods to correct this hazard is by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seatbelt and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of ASME B56.1-2004), Section 7.41, Operator Restraint Systems.

29 CFR 1926.20(b)(2): The employer failed to initiate and maintain programs that provided for frequent and regular inspections of the job sites, materials, and equipment were made by competent persons designated by the employer:  On Arviso Road and on Valley Center Road/State Route S6, a competent person did not inspect the worksite to ensure traffic control conformed to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference exposing employees to struck-by hazards.
