29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: At a jobsite in the 800 block of Kansas Avenue in Topeka, Kansas, an employee was exposed to struck-by hazards in that the employee was in the trench directing the placement of cement fill while the active bucket of a Komatsu excavator was in close proximity. The employee was not wearing a hard hat.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees At a jobsite in the 800 block of Kansas Avenue in Topeka, Kansas, an employee in a trench greater than 4 feet deep and in excess of 75 feet in length, was exposed to injuries from the inability to safely exit the trench in that no ladder was placed in the trench.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. At a jobsite in the 800 block of Kansas Avenue in Topeka, Kansas, an employee in the trench directing the placement of cement fill was exposed to struck-by and cave-in hazards caused by the spoil pile(s) being placed on the edge of the excavation. Two Komatsu track excavators were actively working atop the spoil piles above the employee while he was in the trench.
