OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards created by damaged racking systems. a. 125 Castle Rd., Secaucus, NJ - Warehouse 3 Employees were exposed to struck by hazards of collapsing racks of the metal storage racking system while the employees warehoused merchandise which included, but was not limited to boxes, clothing, shoes and other means of packaging for merchandise. Commercial steel storage racks had bent or damaged stanchions at the base. Violation observed on or about August 28, 2014 b. 125 Castle Rd., Secaucus, NJ - Warehouse 2 Employees were exposed to struck by hazards of collapsing racks of the metal storage racking system while the employees warehoused merchandise which included, but was not limited to boxes, clothing, shoes and other means of packaging for merchandise. A directional sign to the emergency exit through the trash compactor area was not installed. Violation observed on or about August 28, 2014 b. a. 125 Castle Rd., Secaucus, NJ - Warehouse 1 NBA Signs indicating the direction of travel to the nearest exit where not posted in warehouse 1 (NBA Section) and the exit was not immediately apparent to employees and temporary employees. The location of the emergency exit was obscured by the merchandise racking system. Violation observed on or about August 28, 2014 c. 125 Castle Rd., Secaucus, NJ - Warehouse 3 - Northwest exit door Signs indicating the direction of travel to the nearest exit where not posted in warehouse 3 (H&M) and the exit was not immediately apparent to employees and temporary employees.
