29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.   (a)        Porta Power, Inc. @ 1717 E 39th Ave.  Denver, CO 80205: On or before August 28th, 2014, the employer did not conduct an exposure assessment prior to beginning work on Asbestos Containing Materials (ACM) on the roof. This condition exposed employees to respiratory hazards associated with exposure to asbestos.

29 CFR 1926.1101(g)(8)(ii)(F): Upon being lowered, unwrapped material shall be transferred to a closed receptacle in such manner so as to preclude the dispersion of dust.   (a)        Porta Power, Inc. @ 1717 E 39th Ave.  Denver, CO 80205: On or before August 28th, 2014, the employer did not provide a closed receptacle for the disposal for Asbestos Containing Materials (ACM) roofing materials.   Roofing tiles which contained between 5-15% asbestos were thrown off the roof into a dump truck.  This condition exposed employees to respiratory hazards associated with exposure to asbestos.

29 CFR 1926.1101(k)(2)(i): Before work subject to this standard is begun, building and facility owners shall determine the presence, location, and quantity of ACM and/or PACM at the work site pursuant to paragraph (k)(1) of this section.  (a)        Porta Power, Inc. @ 1717 E 39th Ave.  Denver, CO 80205: On or before August 28th, 2014, the employer did not determine if the roofing materials, which were being removed by a roofing subcontractor, contained asbestos.  This condition exposed employees to asbestos hazards.

29 CFR 1926.1101(k)(2)(ii)(C): The building owner and/or facility owner did not notify all employers of employees who work within or adjacent to the areas containing asbestos containing materials (ACM) and presumed asbestos containing materials of the presence, location and quantity:  (a)        Porta Power, Inc. @ 1717 E 39th Ave.  Denver, CO 80205: On or before August 28th, 2014, the employer did not inform roofing subcontractors that the roofing materials being removed/replaced contained asbestos prior to the start of work.  This condition exposed employees to respiratory hazards associated with exposure to asbestos.
