29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:  (a) On or about August 20, 2014, and at times prior, for employees that assist physicians with cosmetic medical procedures requiring the use of sharps, such as but not limited to Botox injections, at the Spa West Cosmetic Center, Inc. located at 29109 Center Ridge Road in Westlake, Ohio.   (b) On or about August 20, 2014, for the employee that cleaned a procedure room, which included emptying the trash can, where a physician performing Botox injections had left used needles in the regular trash at Spa West Cosmetic Center, Inc. located at 29109 Center Ridge Road in Westlake, Ohio.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about August 27, 2014, and at times prior, for the employees working with chemical cleaners such as 409, Opti-Cide-3 Surface Disinfectant Wipes and Barbicide, and other salon chemicals classified as irritants, such as nail polish and remover, hair color and perms, at Spa West and Spa West Cosmetic Center located at 29109 Center Ridge Road in Westlake, Ohio.
