29 CFR 1910.28(a)(1): Scaffolds were not furnished or erected in accordance with this standard for persons engaged in work that could not be done safely from the ground or from solid construction:  A)    Better Brake Parts, Inc., located at 915 Shawnee Road, Lima, OH 45805: On or about September 2, 2014, the employer failed to ensure that work that cannot be done safely from the ground, or from solid construction, was done from a mobile work platform such as, but not limited to, a mobile ladder stand or rolling scaffold. Employees were climbing the shelves of the racking system in order to gain access to the top shelf. Employees were exposed to the fall hazards of approximately 10 feet from the top shelf to the concrete ground below.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Boxes with product in the warehouse were not placed in a manner that would prevent them from falling down, exposing employees to struck-by hazards.    B)     Better Brake Parts, Inc., located at 915 Shawnee Road, Lima, OH 45805: On or about September 2, 2014, the employer failed to ensure that the shelving units, exposed to powered industrial vehicle traffic in the warehouse area, were secured to the floor/wall from being tipped over if struck by a powered industrial vehicle. Employees, working in the area, were exposed to struck-by hazards from boxes on the shelves and the shelving itself.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
