29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:                                                        (a)    Superior Maintenance, Inc. at McCaslin Blvd. & High Plains Dr., Superior, CO 80027: On and before August 29, 2014, the employer did not ensure that employees conducting work in the excavation were provided with a safe means of egress from trench excavations, in that a stairway, ladder, ramp or other safe means of egress was not available for employees to use.  This condition exposed the employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift.    (a)    Superior Maintenance, Inc. at McCaslin Blvd. & High Plains Dr., Superior, CO 80027: On and before August 29, 2014, the employer did not ensure that an inspection of the excavation, the adjacent areas, and protective systems was conducted by the competent person as needed throughout the shift. The competent person did not re-evaluate the excavation as necessary when a known hazard was present and allowed employees to enter an unprotected trench that was approximately 6-8 feet deep.  This condition exposed the employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):      (a)    Superior Maintenance, Inc. at McCaslin Blvd. & High Plains Dr., Superior, CO 80027: On and before August 29, 2014, the employer did not ensure that employees conducting work in the sewer line excavation were protected from cave-in, in that the excavation was approximately 6-8 feet deep and was not protected from cave-ins. The working area lacked any protective system, such as appropriate sloping, benching, or shield system.  This condition exposed the employees to a crushing hazard by excavation wall cave-in.
