29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:  a) Jobsite, Third Street Flats, 4th Floor, Unit 1 - Employees were performing carpentry operations within 2 feet of an unprotected 2 foot wide x 6 foot 2 inch high window opening, 33 feet above ground level without fall protection, observed on or about 8/11/14.  b) Jobsite, Third Street Flats, 3rd to 4th Floor Stairs, Unit 1 - Employees were using stairs within 2 feet of an unprotected 2 foot wide x 8 foot 2 inch high window opening, 21 feet above ground level without fall protection, observed on or about 8/11/14.  b) Jobsite, Third Street Flats, 2nd Floor, Unit 2- An employee was performing carpentry operations within 2 feet of an unprotected 9 foot 1 inch wide x 40 inch high window opening, 10 feet above ground level without fall protection, observed on or about 8/11/14.

Employees did not know the height stairways should be equipped with stairrails, on or about 8/11/14.
