OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: An employee was performing maintenance on a commercial sign located on a roof top of a commercial structure was exposed to a fall hazard while climbing up and down on a 8' Werner Fiberglass Step Ladder. The step ladder was leaned against the wall of the commercial structure to gain access to the roof top that is not intended to be used in this manner per manufacturer specifications.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: An employee was observed standing at the edge of a low sloped commercial roof while spraying a solution on a commercial sign to be cleaned without the use of any personal fall protection equipment exposing employee to a fall hazard greater than 7 feet to the ground below.
