29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):      (a)     Horizon Construction Group, Inc., at 8133 E. 29th Place, Denver, CO 80238: On or before August 4, 2014, the controlling employer did not ensure a safety program was implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Approximately two to three subcontractor employees were exposed to fall hazards greater than six feet associated with deck work and roofing activities of a four story apartment building while not using adequate fall protection systems.  This condition exposed the subcontractor employees to falls ranging from approximately 9 to 36 feet to the ground below.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system, or by the use of a safety monitoring system alone:       (a)     Horizon Construction Group, Inc., at 8133 E. 29th Place, Denver, CO 80238: On or before August 4, 2014, the controlling employer did not ensure their employee was protected from injury, in that a subcontractor employee engaged in roofing activities on a flat roof of an apartment building was exposed to falls of approximately 36 feet (4 stories) without the use of an adequate fall protection system.

(a)     Horizon Construction Group, Inc., at 8133 E. 29th Place, Denver, CO 80238: On or before August 4, 2014, the exposing employer did not ensure that employees were protected from injury, in that one employee was standing on an exposed deck of an apartment building with a fall hazard of approximately 9 feet without the use of a fall protection system.       (b)    Horizon Construction Group, Inc., at 8133 E. 29th Place, Denver, CO 80238: On or before August 4, 2014, the controlling employer did not ensure that employees were protected from injury, in that two subcontractor employees were standing on an exposed deck of an apartment building with a fall hazard of approximately 18 feet without the use of a fall protection system.
