NOTE: Construction Reference: 1926.59 The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter.  29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area:  a)  The employer did not provide employee(s) with effective training regarding the health hazards of crystalline silica to which they were exposed when using a gas powered cut-off saw to dry-cut the concrete pavement.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

NOTE: Construction Reference: 1926.59 The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter.  29 CFR 1910.1200(h)(2)(iii): The employer did not provide information to the employees as to the location and availability of the written hazard communication program, and material safety data sheets required by 29 CFR 1910.1200:  a) The employer did not provide information regarding the availability and location of the written hazard communication program to employees exposed to hazardous chemicals in the workplace (i.e. Crystalline Silica).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
