Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized fall, struck-by and crushed-by hazards that are causing or likely to cause death or serious physical harm to his employees:    a) This violation occurred on or about September 18, 2014, at a workplace located at 350 W. Heritage Drive, Tyler, Texas 75703; where at least one (1) employee entered into a wooden bin to remove trash and construction debris from the 4th story of the building.  The wooden bin was elevated by a rough-terrain forklift truck and rested unsecured on the forks, which were exposed the employee to the hazards of falling to the lower level and being struck-by and crushed by falling trash, construction debris, and the wooden bin.       b) This violation occurred on or about September 18, 2014, and at times prior thereto, at a workplace located at 350 W. Heritage Drive, Tyler, Texas 75703; where employees, traveling in and working from an unsecured wooden bin that was supported and elevated by a rough-terrain forklift, were exposed to the hazards of falling to the lower level and being struck-by and crushed-by the wooden bin.
