29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part:    a. On or about September 16, 2014, at the above addressed jobsite, a safety and health program, which would address those hazards associated with the employees' work environment and the company's procedures to eliminate exposure to those hazards had not been developed and maintained.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a. On or about September 16, 2014, at the above addressed jobsite, an employee working from the top of the entrance canopy, air nailing the plywood sheeting in place, was exposed to falls of approximately 16.8 feet due to the lack of fall protection.
