OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a.  On or about September 27, 2014, an employee was operating a Hyster pneumatic-tired roller, model number C530A, in order to compact aggregate on the berm of a newly paved road without any means of rollover protection, thereby exposing the employee to the hazards associated with a rollover.
