OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by crushing hazards: (a) A Jansen Masonry Construction, Inc. employee on or about September 25, 2014 was critically injured while operating a Lull 844C-42 8T50, Serial Number 02-11940 without wearing a seat belt. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. (a) Jansen Masonry Construction, Inc. on or about September 25, 2014 had an employee moving a Lull 844C-42 8T50 Extend-A-Boom Fork Lift by Lull, Serial Number 02-11940 on a grade that was not constructed and maintained to safely accommodate the movement of the equipment. The Lull turned over while backing on the grade.
