OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards:    a) Hand pack storage area: Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in three sections, on or about 10/1/14.    b) Artisanal storage area; Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in three sections, on or about 10/1/14.    c) East side dry bulk storage area: Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in three sections,  on or about 10/1/14.    d) West side dry bulk storage area: Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in three sections,  on or about 10/1/14.      e) Freezer bulk storage area: Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in four sections, on or about 10/1/14.        f) Freezer Whole Foods storage area: Employees were exposed to racks storing products three shelves high that had damaged feet on the vertical uprights in four sections, on or about 10/1/14.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Dry pasta packing room: A continuous band sealer where employees placed dried bags of pasta for sealing was not guarded to protect employees fingers from an in-going nip point, on or about 10/1/14.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
