29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training would be met:    (a) Fox Berkshire - The employer did not develop and implement a written hazard communications program for employees who are exposed to chemicals such as but not limited to Envirox concentrate 118 and bathroom porcelain cleaner, on or about October 2, 2014.        Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees had not previously been trained about was introduced into their work area:    Fox Berkshire - The employer did not provide employees information and training on the chemicals they work such as but not limited to Envirox Concentrate 118 and bathroom porcelain cleaner, on or about October 2, 2014.       Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation had been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:    (a) Fox Berkshire Theatre - The employer did not certify that a hazard assessment was performed through a written certification for employees who are required to wear gloves while cleaning the bathrooms and other areas of the theatre, on or about October 2, 2014.        Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
