OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls of approximately 10 feet in height to the ground level below, when using a damaged Werner 10 feet fiberglass step ladder, which was missing the back side portion of the ladder, while gaining access and egress to and from the first level of the pole scaffold.

29 CFR 1926.304(d): 29 CFR 1926.304(d): Each portable, power-driven circular saw withdrawn from the work did not automatically and instantly return the lower guard to the covering position of the saw:     On or about October 01, 2014, employee was exposed to the hazard of coming in contact with the saw blade, when using a DeWalt hand held circular saw model #DWE575, where the lower blade guard had a wood shim wedged into the guard, keeping the guard in the open position, while employee was cutting plywood sheathing for the residential home.

Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section:     On or about October 01, 2014, employee was exposed to fall hazards of greater than 10 feet in height to the ground level below when working from a scaffold which was not designed and/or constructed by a qualified person when the pole scaffold was constructed using 2X6's nailed to the wall, 2X4's 20 feet in length used for pole legs and no cross bracing, while installing the thermal paper on the front of the residential home.
