29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  The employer does not ensure that employees constructing a leading edge 6 feet or more above lower levels are protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. This violation was observed on or about October 2, 2014, on the flat roof of a newly constructed commercial facility where employees were exposed to an approximately 20 foot fall hazard when installing plywood to the leading edge without a fall protection system.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee who is constructing a leading edge 6 feet or more above lower levels is protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  The employer does not ensure that listed, labeled, or certified equipment is installed and used in accordance with instructions. This violation was observed on or about October 2, 2014, where employees were using a blue handy box attached to an extension cord to power a saw and cordless drill charger. The handy box was not used as listed, but was plugged into a functioning GFCI.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that listed, labeled, or certified equipment is installed and used in accordance with instructions included in the listing, labeling, or certification.

29 CFR 1926.405(g)(2)(iii): Flexible cords were not used in continuous lengths without splice or tap:  The employer does not ensure that flexible cords are used in continuous lengths without splice or tap. This violation was observed on or about October 2, 2014, where employees were using a Porter-Cable 8-inch circular blade saw without the cord being of continuous length without splice or tap.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that flexible cords are used in continuous lengths without splice or tap.
