29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed at the construction site on or about October 03, 2014 where an employee was exposed to a 20 ft. fall hazard when performing roofing activities on a residential structure without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. The employer does not ensure that ladder used by employees is extended at least 3 feet above the upper landing surface. This violation was observed at the construction site on or about October 03, 2014 where an employee was exposed to a 7 foot fall while using an extension ladders to access a roof without extending the ladder side rails at least three feet above the roof landing or securing the top of the ladder to the roof landing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extended at least three feet above the roof landing, or securing the top of the ladder to the roof landing.
