29 CFR 1926.28(a):   The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.  On 10/03/2014, workers from Wilmer Gutierrez were repairing a roof of a residential building located at 7202 Gadwall Way, OFallon MO.   Three employees were not required to wear eye protection while using pneumatic nailers.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.  On 10/03/2014, workers from Wilmer Gutierrez were repairing a roof of a residential building located at 7202 Gadwall Way, OFallon MO.   They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems.

29 CFR 1926.1053(b)(22):      An employee did carry any object or load that could cause the employee to lose balance and fall.  On 10/03/2014, workers from Wilmer Gutierrez were repairing a roof of a residential building located at 7202 Gadwall Way, OFallon MO.   An employee was carrying bundles of shingles up a two ladders; one ladder was used to gain access to the first story and the other was used to access the second story.  The employee could have lost his balance and fell.
