29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  1065 South Street, Needham, Ma:  Site, Asphalt Dump Truck and paving job: Employees are exposed to fall and burn hazards due to lack of proper personal protective equipment while in the raised dump body of an asphalt truck containing hot asphalt.  1. A worker standing on hot asphalt in the bed of the truck was burnt on his legs when a chute was opened and the asphalt shifted and he sank into the hot asphalt. The injured worker was wearing shorts.  2. The worker was in the raised dump body exposed to falling without fall protection.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  1065 South Street, Needham, Ma.:  The employer did not develop locxkout tagout  procedures for when employees, shoveling asphalt inside a dump body, were exposed to burns, struck by, crushed by, and engulfment hazards. On or about 10-7-14 an employee was shoveling asphalt inside a dump body of an asphalt truck when another worker opened a chute and the worker's legs fell into the chute and the worker had suffered burn injuries.
