29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: The employer does not ensure scaffold platforms that are more than 2 feet (0.6 m) above or below a point of access that portable ladders, attachable ladders, stair towers etc. are used. This violation was observed on or about October 3, 2014, on the north east side of the construction site where an employee was exposed to fall hazards when accessing a scaffold platform which was 2 feet or more above an access point without a proper access device. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a proper means of access is provided when accessing a scaffold platform more than 2 feet above or below a point of access.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. The employer does not ensure employees are protected by the use of a guardrail systems or personal fall arrest system. This violation occurred on or about October 3, 2014 on the north east side of the construction site when employees was exposed to a fall greater than 10 feet while performing stucco work from the fourth level of a scaffold without guardrails or a personal fall arrest system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a personal fall arrest system or guardrails are installed when working from a scaffold 10 feet or more above a lower level.

The employer does not ensure that the frames and panels were braced to secure vertical members together laterally. This violation was observed on or about October 3, 2014 on the north east side of the construction site where employees were exposed to fall hazards when completing stucco activities on the fourth level of a scaffold without cross bracing to secure vertical members together laterally. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all framed scaffold and panels are braced by cross, horizontal, or diagonal braces, or combination thereof, to secure vertical members together laterally before employees use.
