29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected by a fall protection system. This violation occurred on or about October 8, 2014, at the work site, where an employee was exposed to an 11 foot 8 inch fall hazard while performing waterproofing work on the second level balcony of a multi-family residential building under construction without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees engaged in residential construction activities at heights six feet or more are protected from falling.
