29 CFR 1917.43(b)(1): Capacity, operation and maintenance instruction plates, tags, or decals on modified powered industrial trucks were not changed to conform to the equipment as modified: a.) American Borate Company: On or about 12/15/14, an instruction plate or equivalent was not affixed to the Yale forklift truck serial number B875V08809K used to suspend a 2000-pound bag off the tines of the forklift. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a.) American Borate Company, Warehouse #3: On or about 10/03/14, employees exposed to chemicals such as Colemanite, Boric Acid, Etidot-67 and Ulexite, were not provided information and training on the hazards of these chemicals and in the requirements of the Hazard Communication Standard. No abatement certification or documentation required.
