OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:    The employer is failing to ensure that fabric slings were protected from sharp edges while lifting and holding a load with sharp edges, which is known to be a falling load hazard. Employees were exposed to physical harm such as a struck-by an overhead hazard due to an employee was helping to install a drag conveyor system on the foundation of a grain elevator leg. Another employee was operating a crane that had the drag conveyor suspended in the air and was ready to put into position. The fabric sling that was holding the drag conveyor snapped and the drag conveyor fell, landing on the employee under the load, causing fatal injuries. This most recently occurred on or about  October 9, 2014 at N Wilkinson St., Thurston, NE 68062 (Jobsite).

An employee was operating a crane that had the drag conveyor suspended in the air and was being moved for its' placement into a final position. The fabric sling that was holding the drag conveyor snapped and the drag conveyor fell, landing on the employee under the load, causing fatal injuries. This most recently occurred on or about October 9, 2014 at N Wilkinson St., Thurston, NE 68062 (Jobsite).      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. An employee was operating a crane that had the drag conveyor suspended in the air and was ready to put into position. The fabric sling that was holding the drag conveyor snapped and the drag conveyor fell, landing on the employee under the load, causing fatal injuries.        Abatement certification is required for this violation.  Abatement certification sheet is enclosed with the citation.
