OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  On or about October 11, 2014, at the jobsite located along Prairie Star Parkway, Lenexa, KS: Employees engaged in grass cutting operations along the roadway median were exposed to struck-by hazards from vehicular traffic. Traffic control signs and devices were not in place to warn motorists of roadwork activities nor were other effective means in use to control vehicular traffic.    Among other methods, recognized and feasible means of abatement to correct this hazard is to:  a.  Eliminate the need for employees to work in the roadway when cutting and clearing grass clippings.  b.  The employer shall follow the U.S. Department of Transportation Manual on Uniform Traffic Control Devices to include establishing an effective means for controlling pedestrian and vehicular traffic on every job site.
