29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  (a)  2nd floor window ledge - On or about October 14, 2014 two employees were exposed to a fall hazard while standing in an unauthorized open wooden box used as a scaffold. This box was elevated by a Skytrak 6042 Telescopic Forklift serial no. 10147236. This box was not designed by the manufacture to support employees.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  (a)   2nd floor window ledge - On or about October 14, 2014 two employees were exposed to a fall hazard while standing in an unauthorized open wooden box used as a scaffold. This box was elevated by a Skytrak 6042 Telescopic Forklift serial no. 10147236. These employees were elevated 21 feet above concrete with no fall protection.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)  2nd floor window ledge - On or about October 14, 2014 two employees were exposed to a fall hazard while standing on a window ledge without fall protection 21 feet above concrete.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  (a)   Construction site - On or about October 14, 2014 the employer did not implement or maintain a Hazardous Communication Program.  Employees were exposed to Sunnyside Paint Thinner without the availability of a Safety Data Sheet (SDS) in the work area.
