29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:      a) On or about 10/22/14, in the back of Sperry Store #320 at the Fashion Outlets of Niagara Falls, 1900 Military Rd., Niagara Falls, NY:  An employee fishing down a cable was standing on the sixth rung of an unopened  Louisville 10 ft.  fiberglass extension ladder  setting  on the floor and propped against the wall at a steep angle. The stepladder was not designed  to be used in this manner.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder:    a) On or about 10/22/14, in the back of Sperry Store #320 at the Fashion Outlets of Niagara Falls, 1900 Military Rd., Niagara Falls, NY:  An employee fishing down a cable was standing on the sixth rung of an unopened  Louisville 10 ft.  fiberglass extension ladder  setting  on the floor and propped against the wall at a steep angle. The stepladder was in an open doorway leading to the service hallway  and was not secured  or barricaded to prevent  accidental displacement.     NO ABATEMENT CERTIFICATION REQUIRED
