OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls:  a)  Superior Universal Services [SUS]/ Cooper Farms Site in Wilmington, Delaware: The employer nor their competent person performed an evaluation of the 2510 Duncan Road site prior to any work or climbing activities being implemented. A feasible and acceptable abatement method to correct the hazard would be to:  1) Provide adequate training and instructions to employees to wear and utilize personal protective equipment, including properly tying off and properly securing anchorage points. 2) Train the employees in accordance with ANSI/TIA-1019-A Section 2.15 of Annex A.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Superior Universal Services, Inc. [SUS] - Cooper Farms Site in Wilmington, Delaware: The employees of SUS involved in the installation of fiber cables, a growth cabinet and remote radio units at the 2510 Duncan road site were exposed to a fall hazard as open platform sides were unprotected and the personal fall arrest system was not properly used.  This occurred on or about October 8, 2014.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached.  a) Superior Universal Services [SUS]/ Cooper Farms Site in Wilmington, Delaware - Employees performing modification work which involved installation of fiber cables, a growth cabinet, and panel antennas on a water tower being used by telecommunication companies were not provide adequate training in identifying anchorage points for the attachment of a personal fall arrest system. The employees tied off to a vent pipe and a ladder which were not capable of or designed to support 5000 pounds per employee attachment. This occurred on or about October 8, 2014.
