29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) 4 Berkeley Avenue , north side and west end of the unit- Employees without proper training were working from two improperly setup aluminum pump jack scaffolds, on or about 10/27/14.    b) 4 Berkeley Avenue , west side and north corner of the unit- Employees without proper training were working from two improperly setup aluminum pump jack scaffolds, on or about 10/27/14.      Certification  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.    a) 4 Berkeley Avenue , north side and west end of the unit -  Employees were working approximately 27 feet above the ground, from a pump jack scaffold system with numerous defects such as: poles not braced at the top and bottom, on or about 10/27/14.    b) 4 Berkeley Avenue , west side and north corner of the unit - Employees were working approximately 27 feet above the ground, from a pump jack scaffold system with numerous defects such as: poles not braced at the top and bottom, on or about 10/27/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas.  a)  4 Berkeley Avenue, south at north side of the unit- Employees without fall protection exposed to a fall hazards of approximately 18 feet above the ground when performing outside cedar shake siding and PVC white wood trimming. These employees had not received any fall protection training from the company on or about 10/27/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
