29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards: Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.  a)  Worksite, 88 Old Dock Rd. Yaphank NY - Employees were exposed to falling approximately 10ft, while walking across an unguarded platform under the KWS Steel Apron Belt Conveyor; on or about 11/7/14.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.159(c)(8)(iii): Sprinklers on automatic sprinkler systems were not protected from mechanical damage:   a) Worksite, 88 Old Dock Rd. Yaphank NY - A sprinkler head located in the transfer station was broken due to the accumulation of construction debris; on or about 11/7/14.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
