Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a)Roof top at 40 Meridan, Rockaway, NJ:Employees observed conducting roofing work without utilizing any type of fall protection, exposing the employee to fall hazards. Violation observed on or about 10/20/14.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) Work Site: 40 Meridan, Rockaway, NJ 07866 Employees were exposed to falls in excess of 20 feet to the ground below as the ladder's side rails did not extend at least 3 feet above the surface being accessed. Violation observed on or about 10/20/2014.
