29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the jobsite, materials, and equipment to be made by a competent person:     (a)Junior & Senior Builders, LLC @ 8200 20th Street, Greeley, CO 80634: On and before October 21st, 2014, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure that a competent person conducted inspections of the jobsite to ensure that fall protection systems were utilized by employees. Employees were engaged in residential framing activities 6 feet or more above lower levels such as, but not limited to the following instances: erecting trusses and  rafters, standing on the interior/exterior plates unprotected, sheathing floors sheathing roofs while standing in close proximity to the unprotected edge. The conditions exposed employees to the hazard of falling approximately 10 feet to 22 feet.     Abatement note: The requirements and duties of a competent person are:  (1)A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.  (2)The competent person must understand and be able to carry out the tasks specified in the OSHA standard.  The competent person must have knowledge about fall protection systems or plans, and the safety program.

29 CFR 1926.1052(c)(1)(ii) Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a standard stairrail system along each unprotected side or edge.     (a)Junior & Senior Builders, LLC @ 8200 20th Street, Greeley, CO 80634: On and before October 21st, 2014, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure that the stairway used by framing crew members to gain access to the 2nd floor of the residential apartment building under construction, was provided with a standard stairrail system along each unprotected side or edge. This condition exposed the employees to the hazard of falling10 feet when ascending and descending the stairway.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing, and was not secured to provide safe access.  (a)Junior & Senior Builders, LLC @ 8200 20th Street, Greeley, CO 80634: On and before October 21st, 2014, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure that the extension ladder used by framing employees to gain access to the exterior wall top plate, was extended at least 3 feet above and secured to prevent displacement when ascending and descending the ladder.  This condition exposed employees using the ladder to the hazard of falling approximately 10 feet to ground.

CFR 1926.501(b) (13):  Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels was not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:    (a)Junior & Senior Builders, LLC @ 8200 20th Street, Greeley, CO 80634: On and before October 21st, 2014, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure fall protection systems were  person conducted inspections of the jobsite to ensure that fall protection systems were utilized by subcontractor framing employees. Subcontractor framing employees were exposed to fall hazards while engaged in residential construction activities 6 feet or more above lower levels such as, but not limited to the following instances: erecting trusses, standing on the interior/exterior top plates, sheathing floors, and sheathing roofs of a multi-family residential apartment complex under construction. The conditions exposed the employees to the hazard of falling approximately 10 feet to 22 feet.   Junior & Senior Builders, LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 910818,  Citation Number 1, Item Number 1 issued on September 24, 2013, with respect to a workplace located at 4908 Boca Del Rio, Fort Collins, Colorado 80524 and became Final Order on March 5, 2014.
