29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about October 30, 2014, and again on October 31, 2014 A). Employees entering, exiting and working on the first floor of the project were exposed to fall hazards because the flooring materials had been removed and exposed the open floor joists to the basement below. Employees were not protected from falling into the basement by any means of Personal Fall Protection, Guardrails, or Safety Netting.

29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date and stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan.Temporary treads and landings used for pan stairs that were to be filled in with concrete or other solid material at a later date were worn below the level of the top edge of the pan. On or about October 30, 2014 and October 31, 2014 Location: 155 West 126th Street, New York, NY every stair well throughout the project. Employees were traversing throughout the project using stairwells and were exposed to trip and fall hazards because the stair landing pans were not filled in with a solid material and the material used to fill stair treads had been worn down below the top lip of the tread pan.

Employees were exposed to fall hazards because the stair systems was not equipped with a handrail system along each unprotected side or edge of the stairs.

On or about October 30, 2014 and October 31, 2014 Location: 155 West 126th Street, NY NY, 4th floor east side of stairs. Employees were utilizing a temporary electrical outlet box to energize portable power tools, that was not protected from ground fault electrical shorts, because the temporary wiring system was not protected by a ground fault circuit interrupter.
