29 CFR 1910.29(a)(3)(v): The work level platform of scaffolds (towers) was not of wood, aluminum, or plywood planking, steel or expanded metal, for the full width of the scaffold, except for necessary openings.     On or about October 30, 2014, employer did not ensure that the mobile scaffold was fully planked. This condition exposed employee to fall exceeding 4 feet.

29 CFR 1910.29(a)(3)(vii): Work levels 10 feet or higher above the ground or floor did not have  a guardrail of 2" x 4" nominal or the equivalent, installed no less than 36" or more than 42" high, with a mid-rail of 1"x 4" nominal lumber or equivalent:    On or about October 30, 2014, the employer did not ensure that the mobile frame scaffold had the middle and top guard rails installed. This condition exposed employee to falls exceeding 10 feet.
